Check a district's FMLA handbook text and blank notice templates against the employer notice rules
Takes the leave section of a district's employee handbook and its blank FMLA notice templates (no employee names, leave requests or medical information) and drafts a gap list against 29 CFR 825.300. It checks that the general notice is posted where employees and applicants can see it and is included in the handbook or given to each new hire, with at least the information in WHD Publication 1420, and flags whether a translated notice may be needed under 825.300(a)(4). It checks that the eligibility notice template states eligibility and at least one reason when an employee is not eligible, and notes the five business day timing. It checks the rights and responsibilities template for the 825.300(c)(1) items as appropriate: designation against the leave entitlement and the 12-month period, certification requirements and consequences, substitution of paid leave, premium payments for health benefits, key employee status, maintenance of benefits and job restoration, and possible liability for premiums if the employee does not return. It checks that the designation notice template is written, covers fitness-for-duty notice where required, and states the amount of leave counted. Each item is marked found, not found or needs review.
Human in the loop: The HR director reviews the gap list and owns the templates and handbook. The workflow does not decide eligibility, designate leave or handle any individual case. Limits: State leave laws and collective bargaining agreements can add requirements, and special rules for school employees are not checked here. Inputs exclude all individual employee records. Not legal advice. Methodology 1.0: Strong candidate for replay.
